Terms of Use

Version: 1.0  •  Last updated: 11/06/2025

These Terms of Use (the “Terms”) govern access to the wp-auto-publish.com website (the “Site”) as well as use of the WP Auto Publish WordPress plugin and related services (together, the “Services”). By accessing the Site and/or using the Services, you unreservedly accept these Terms, our Privacy Policy, and our Refund Policy.

1) Purpose and Scope

These Terms govern use of the Site, customer accounts, WP Auto Publish plugin licenses, and related features (editorial automation, AI integrations, image generation, etc.). They apply to both professionals and individuals using WordPress.

In the event of any conflict, specific terms (e.g., an enterprise agreement) take precedence over these Terms.

2) Definitions

  • “Customer”: any person or entity that purchases a license.
  • “License”: the right to use the plugin, according to the selected plan (Single, Plus, Multi).
  • “Authorized Site”: a domain name registered/activated under the license.
  • “Updates”: new versions, patches, and improvements.
  • “Data”: personal or technical data processed through the Services.

3) Customer Account & Security

Creating an account is required to manage your license, authorized sites, and billing. You are responsible for keeping your credentials confidential and for all activity conducted through the account.

You agree to provide accurate information and keep it up to date. We may suspend the account in case of fraudulent use or breach of these Terms.

4) Plugin License

Subject to payment of applicable fees, we grant you a non-exclusive, non-transferable license, limited to Authorized Sites, for the duration of your subscription. Depending on your plan, you may activate the plugin on a defined number of sites.

The license does not transfer any intellectual property rights. The code remains protected by copyright and, where applicable, relevant open-source licenses.

5) Usage Restrictions

  • No reverse engineering, decompilation, or circumventing technical limits.
  • No use beyond Authorized Sites, and no unauthorized resale.
  • No unlawful use (illegal content, infringement of third-party rights, spam).
We may suspend or terminate access in the event of serious or repeated breaches.

6) Updates, Changes & Maintenance

We regularly publish updates (security, compatibility, features). Some changes may modify or remove features. Availability may be interrupted for maintenance.

7) Pricing, Payment & Billing

Prices are indicated on the dedicated page and may vary by currency, applicable taxes, and promotions. Payment is processed via a secure provider (e.g., Stripe). Fees and taxes may apply depending on your country.

Invoices are available from your account. In case of payment failure, we may retry and/or suspend access until resolved.

8) Renewal, Termination & Deletion

Unless otherwise stated, licenses automatically renew at the end of the term. You can disable auto-renewal from your account before the billing date.

Termination ends updates and support, with no refund except as provided in the Refund Policy. Deleting the account results in deletion of access and data as required by law.

9) Right of Withdrawal (EU)

If you are an EU consumer, you have a 14-day right of withdrawal for online purchases. By accepting immediate performance (download/activation), you acknowledge waiving this right for the portion already delivered. See the Refund Policy.

10) Data Protection (GDPR)

We process personal data in compliance with the GDPR and our Privacy Policy (purposes, legal bases, retention, recipients, transfers, data subject rights). You can exercise your rights via privacy@wp-auto-publish.com.

11) Intellectual Property

The Site, the plugin, and their components (texts, visuals, logos, code) are protected. Any unauthorized reproduction or use is prohibited. Open-source components remain the property of their authors and are subject to their licenses.

12) User Content

You are solely responsible for content generated, imported, or published through the Services (texts, images, prompts, feeds). You warrant that you have all necessary rights and that you comply with applicable laws.

13) Third-Party Services & Dependencies

Some features rely on third-party services (e.g., payment gateway, AI APIs, CDN). Their availability, policies, and limits apply. We do not control these services and cannot be held liable for their unavailability.

14) Liability & Limitation

  • Availability is not guaranteed continuously (maintenance, incidents, force majeure).
  • Loss of revenue/data: liability excluded to the maximum extent permitted by law.
  • Configuration: you remain responsible for settings and compliance.
To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid in the twelve (12) months preceding the claim for the license at issue.

15) Warranties — Disclaimers

The Services are provided “as is.” Except where prohibited by law, we disclaim all express or implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16) Security & Reporting

We apply reasonable technical and organizational measures. As no technology is infallible, promptly report any suspected vulnerability to security@wp-auto-publish.com.

17) Force Majeure

Neither party is liable for a failure caused by an event reasonably beyond its control (widespread Internet/cloud outage, disaster, conflict, administrative decision, etc.).

18) Miscellaneous

  • Assignment: you may not assign your rights without prior written consent.
  • Severability: if any clause is invalid, the remainder stays in effect.
  • Evidence: logs, emails, exports, and electronic archives constitute proof between the parties.

19) Changes to the Terms

We may update these Terms at any time. The new version applies upon posting. In case of material changes, we may notify you via the Site or email.

20) Governing Law & Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of the State of Wyoming, United States of America, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute, controversy, or claim arising out of or relating hereto shall be submitted to the exclusive jurisdiction of the state and federal courts located in Cheyenne (Laramie County), Wyoming, United States. You irrevocably consent to personal jurisdiction and venue in those courts.

If you are a consumer and mandatory rules of your country of residence require a different forum or additional protections, those rules prevail to the extent they are of public order.

Tip: keep your invoices and license reference handy for any support request.
